Important: Please read these Terms of Service carefully before using GoVitaMed Telehealth Hub. By creating an account, booking an appointment, or otherwise using our services, you agree to these Terms and to our Privacy Notice. If you do not agree, do not use our services.

1) About GoVitaMed Telehealth Hub

  • GoVitaMed Telehealth Hub ("GoVitaMed," "we," "us," "our") provides a platform enabling users to access virtual healthcare services from licensed clinicians and related administrative tools (collectively, the "Services").
  • GoVitaMed is not an insurance provider and does not practice medicine. Clinical services are provided by independent, licensed healthcare professionals or groups ("Providers"), who are solely responsible for patient care.

2) Not for Emergencies

  • Do not use the Services for medical emergencies.
  • If you believe you are experiencing a medical emergency, call your local emergency number (e.g., 911) or go to the nearest emergency department immediately.

3) Eligibility and User Accounts

  • You must be at least 18 years old to create an account, or the age of majority in your jurisdiction. Minors may use the Services only with the consent of a parent or legal guardian and as permitted by applicable law.
  • You agree to provide accurate, current, and complete information and to update it as needed.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately of any unauthorized use.

4) Consent to Telehealth

By using the Services, you acknowledge and agree that:

  • Telehealth involves the delivery of healthcare services via electronic communications, including video, audio, text, and image sharing.
  • Potential benefits include convenience, timely access, and continuity of care. Potential risks include technical failures, incomplete transmission of information, and rare unauthorized access.
  • Your Provider may determine that telehealth is not appropriate for some conditions and may refer you to in-person care.
  • You may withdraw consent to telehealth at any time, though this may affect your ability to receive services.

5) Privacy and Security

  • We describe how we collect, use, disclose, and protect your information in our Privacy Notice and, where applicable, our HIPAA Notice of Privacy Practices.
  • We implement reasonable administrative, physical, and technical safeguards. No system is 100% secure. You are responsible for securing your device and internet connection.

6) Medical Information; No Warranties

  • Information available through the Services is for general educational purposes and is not a substitute for professional medical advice, diagnosis, or treatment.
  • Always seek the advice of a qualified healthcare provider with questions about a medical condition and before changing your treatment.

7) Relationship with Providers

  • Providers are independent professionals solely responsible for the services they provide, compliance with licensure and standards of care, and clinical documentation.
  • GoVitaMed does not control or direct clinical judgment and is not responsible for medical advice or outcomes.

8) Prescriptions and Pharmacy Services

  • Providers may issue prescriptions when medically appropriate and legally permitted. Prescription decisions are solely at the Provider's discretion.
  • We do not guarantee that a prescription will be issued, or that any medication is covered by insurance.
  • Controlled substances and other restricted medications may not be available via telehealth, depending on applicable laws and clinical judgment.

9) Insurance, Billing, and Payment

  • Fees, copays, coinsurance, deductibles, and coverage vary by plan and location. You are responsible for verifying benefits and for all charges not covered by insurance.
  • We may collect payment information and charge your payment method for Services you authorize.
  • Fees are subject to change. We will provide applicable pricing at the time of booking or prior to charge.

10) Scheduling, Cancellations, and No-Shows

  • You may reschedule or cancel appointments as permitted by the platform. Cancellation windows and fees will be disclosed during booking.
  • Missed appointments or late cancellations may result in fees, as allowed by law.

11) User Conduct

You agree not to:

  • Misrepresent your identity, symptoms, or medical history.
  • Record sessions without consent where required by law.
  • Harass, threaten, or abuse Providers or staff.
  • Upload or transmit harmful code, attempt to access non-public systems, or interfere with the Services.
  • Use the Services for unlawful purposes or in violation of these Terms.

12) Technology Requirements

  • You are responsible for obtaining compatible devices, software, and internet access.
  • Service quality may depend on network conditions. We do not guarantee uninterrupted or error-free operation.

13) Content and Intellectual Property

  • The Services, including software, interfaces, text, graphics, and logos, are owned by GoVitaMed or its licensors and are protected by law.
  • You receive a limited, revocable, non-transferable license to access and use the Services for personal, non-commercial purposes.
  • You may not copy, modify, distribute, reverse engineer, or create derivative works except as permitted by law.

14) User Submissions and Feedback

  • You may submit information, reviews, messages, or feedback. You grant GoVitaMed a non-exclusive, worldwide, royalty-free license to use feedback to improve our Services.
  • Do not submit content that is illegal, infringing, defamatory, or that violates privacy or confidentiality obligations.

15) Third-Party Services and Links

  • The Services may integrate or link to third-party sites, apps, pharmacies, labs, or payment processors. We are not responsible for their content, policies, or practices.
  • Your use of third-party services is subject to their terms and privacy policies.

16) Service Modifications and Availability

  • We may modify, suspend, or discontinue any part of the Services at any time, with or without notice.
  • We may restrict or terminate access for violation of these Terms, suspected fraud, or as required by law.

17) Disclaimers

To the fullest extent permitted by law:

  • The Services are provided "as is" and "as available," without warranties of any kind, express or implied.
  • We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
  • We do not warrant that the Services will meet your needs, be uninterrupted, secure, or error-free.

18) Limitation of Liability

To the fullest extent permitted by law:

  • GoVitaMed and its affiliates, officers, directors, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business interruption.
  • Our total liability for claims arising out of or related to the Services will not exceed the amount you paid to GoVitaMed for the Services giving rise to the claim in the twelve (12) months preceding the claim, or one hundred dollars (USD $100), whichever is greater.
  • These limitations do not limit liability that cannot be excluded by law.

19) Indemnification

You agree to defend, indemnify, and hold harmless GoVitaMed and its affiliates from and against claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, violation of these Terms, or infringement of third-party rights.

20) Compliance with Laws; Licensing and Geography

  • Telehealth availability, scope of services, prescriptions, and insurance coverage vary by jurisdiction.
  • You represent that you are physically located in the state or country you select at the time of a visit and that you will not use the Services where prohibited by law.

21) Communications and Consent to Electronic Records

  • You consent to receive communications electronically, including appointment confirmations, disclosures, and updates.
  • You may opt out of non-essential marketing communications. Transactional and service-related messages are necessary to use the Services.

22) App Store Terms

If you access the Services via a mobile app, your use may also be subject to the terms of the app store provider. In the event of conflict, these Terms govern the relationship between you and GoVitaMed.

23) Termination

  • You may stop using the Services at any time. You may request account closure by contacting support.
  • We may suspend or terminate access for any reason, including violation of these Terms. Sections that by their nature should survive termination will survive.

24) Changes to these Terms

  • We may update these Terms from time to time. We will post the updated Terms with a new "Last updated" date and, where required, provide additional notice.
  • Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.

25) Governing Law and Dispute Resolution

  • These Terms are governed by the laws of the state or country where GoVitaMed is organized, without regard to conflict of law principles, unless otherwise required by applicable law.
  • Any dispute will be resolved through binding arbitration on an individual basis and not in a class or representative action, unless prohibited by law. You and GoVitaMed waive any right to a jury trial. Details of the arbitration process will be provided in a separate Arbitration Agreement if applicable.

26) Severability; Entire Agreement; No Waiver

  • If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
  • These Terms, along with any incorporated policies (including the Privacy Notice and, if applicable, HIPAA Notice of Privacy Practices), constitute the entire agreement between you and GoVitaMed.
  • Our failure to enforce any provision is not a waiver of our right to do so later.
